Would you allow me to rephrase myself? The Granite City law is wrong, ethically. I personal believe The supreme court is wrong on this issue. The law being the law however, in concern to church/distance issues, the theocratic people in charge of Granite are allowed to pass the measure.
This decision accepted that governments can have an interest in creating special zoning laws to protect churches and schools (or other organizations). However, it was flatly rejected that religious bodies could permissibly be given sole authority in deciding which establishments should be allowed. When that occurs, the state unconstitutionally transfers its legitimate authority to religious bodies.
When the city permits Holy Family to have that big drunken Orgy they have every year. They ARE giving the church SOLE authority to establish a beer tent on there grounds.
It is also not legal to issue a permit to consume alcohol on the grounds of any school. Holy Family is school as well.
