In Illinois you cant file jointly, some states have allowed that at the civil union level. No gay couple can currently file jointly on federal returns. The "defense of marriage act" stops one state from being forced the recognize the union/marriage of a gay pair from another state, so I would suppose, that in a state like Missouri, where laws are more bigoted against gays than most, hospitals would still not have to recognize a gay "marriage". This would most likely only be a problem in Catholic hospitals. On a side note, rather than comply with the new law, Catholic charities decided it would stop providing adoption services in Illinois..
