“When a public servant does something like that, it causes people to lose faith in government,” Herndon said. “But I must weigh that against his good deeds.”
It was the penalty requested by defense lawyer Clyde Kuehn, and seven months fewer than recommended by U.S. Attorney Steve Wigginton. Kuehn said Bathon was a generous contributor of time and money to children’s charities.
The prosecutor said it was still “significant” prison time for this type of crime and a defendant with no criminal record. Wigginton noted, “He has a good heart and made a terrible mistake.”
