I have my doubts if the hacker your are reffering to (I think he calls himself The Jester) , is really a soldier, anyone can claim to be anything on the internet, he uses a lot of special forces lingo, but that could just be the result of a lot of good research, or hearing the stories of soldiers....
Didn't the Supreme Court rule when it came to the Pentagon Papers in the 70's, (the New York Times article series), that the New York times could not be held legally responsible, only those within the government who let it out could? The soldier in this leak case is already facing his punishment for this...
