Fair enough, but this part is a valid concern:

“Prohibit tracking, creating or maintaining databases of individuals participating in First Amendment activities,”

It's not that they don't still feel the need for them, but if someone is simply participating in non violent protests as defined by the first amendment there is not need to feed those folks into some type of database.... common sense and a valid concern.
