I’m currently having an issue with Capital One Credit card. Six months ago, a family member was the victim of credit card fraud. Four purchases were made the same day beginning with gas at a Royal Farm near Camden Yards and then several purchases at Security Square Mall, until Capital One texted asking if an attempted 5th purchase was legitimate. The account was frozen and stopped further charges, The family member has never been to these locations and has maintained physical possession of the credit card the entire time.
We have spent many hours on the phone with the Fraud section and several letters of complaint, in an attempt to resolve these fraudulent charges without much success. Crapital One’s position is that a chip credit card was used at these locations, and that the chip cards are secure and cannot be counterfeited. Therefore, the cardholder is being held responsible for charges. Sad part, is If we had said the card was lost or stolen, we would not have any liability for the charges.
We have made a Credit card fraud report with Baltimore County Police and forwarded all information to Crapital One, yet they still maintain the chip card is secure and can’t be defeated.
Early on, I spoke with an Eastern District Detective and he told me that he could purchase online for $60.00 what was needed to create a counterfeit chip card. Apparently there is an Apple I-phone App that can be used without the card, but this was not the case.
Does anyone have investigative knowledge of these chip credit card offenses in order to refute Capital One’s position that the account holder’s actual credit card had to have been used?
