This vehicle does look for a depression in the manifold it uses the charge air pressure sensor.
The throttle body was not causing a big enough drop in pressure and the charge sensor and ecu had a problem with this.
After looking alot of VW's and 1 other BMW the flap clearly was not shutting enough so after speaking to the customer a minor adjustment was made and the car shut down alot smoother and the code is not being set anymore.
