1) Hasn't Congress ceded much tariff action to the Executive?
2) Assuming that the Executive can only create NEW tariffs in an emergency, who defines an emergency? If the President were to decide that $39 Trillion in debt is a national emergency, does the SC have the authority to override his EO?
