Supreme Court allows Virginia's removal of non-citizens from voter rolls

The state reported removing at least 1,600 people from voter rolls for allegedly failing to qualify to participate in the presidential election.

Virginia officials asked the Supreme Court to overturn its decision to allow more than 1,600 non-citizens to vote in the presidential election. Donald Trump called the ruling "outrageous."

"Not only will the Commonwealth of Virginia be irreparably harmed absent a stay, so will its voters and the public at large," state officials stressed in their request.

By an executive order signed in early August, Virginia Governor Glenn Youngkin decided to remove these more than 1,600 people from the voter rolls because they are not citizens and thus not eligible to vote.

The Department of Justice (DOJ), through Kristen Clarke, assistant attorney general of the Civil Rights Division, together with a private group, filed a lawsuit against Virginia for violating the rule prohibiting the removal of voters 90 days before an election, as defined in the National Voter Registration Act, even though Youngkin promulgated his order before 90 days remained before the election.

U.S. District Court Judge for the Eastern District of Virginia Patricia Giles admitted the lawsuit for hearing and ruled that the state had to reinstate these individuals to its voter rolls.

Before going to the Supreme Court, Virginia petitioned the 4th U.S. Circuit Court of Appeals. Its three judges, appointed by the Democratic Party, rejected the request.

Stop yelling at me Blu -- my entire point was that they were violating the 90 day quiet period before an election.

It went to the Supreme Court, no surprise these judges overturned it, given their current staffing.

The fact that the names should not have been there in the first place is of no concern though, got it. The SC fixed it, but the fact that they even had to look at it is concerning. Conservatives are calling this kind of thing a big win. It isn't a big win, it's embarrassing that it even came to this.

It's a big concern and something that should be investigated... who registered them? were they, in fact, immigrants who were not citizens?

Well my last post hit twice and I wasn't even done with my thoughts. So, here's more... Joe, I know you believe all Dems want noncitizens to vote because it will help them and that's just not true.

This is not a widespread problem even though MAGA wants to pretend it is.... in anticipation of screaming fraud if Trump loses.

The Georgia Secretary of State did an audit in 2022 that found over the previous 25 years, fewer than 1,700 people believed to be noncitizens had attempted to register to vote. None were able to cast ballots.

Can you point to any sources that have uncovered widespread voter fraud?

What? Common Sense prevailed! Personally, I think ICE should be the only people responsible for voter registrations. You come in to register, cannot prove citizenship you go on the bus, back to Mexico you go. Kill two birds with one stone. Just think how clean those voter roles would be.

I don't know what ALL Democrats want, but I do know that many Democrats are quite comfortable knowing that in what might be a tight election, they have that little cushion to fall back on. I know this much, you don't hear all that many Democrats complaining about voter fraud, and it's probably for a pretty good reason.

Both parties should fight all forms of voter fraud, and the penalties should be more than a hand slap.

So... all 18 year olds and new residents to a state would have to register through ICE? Hmmm, ok

If State Election authorities must rely in full or in part on the DMV / I wonder how quick it’s done?

A registered voter’s application for a driver’s license is written proof that he is now a legal resident of the state in which he is applying for the license.

Documentation received from a DMV that a registered voter now holds a driver’s license in a different state proves that his eligibility to vote is in the new state.

Such certification is written proof under the NVRA that a voter should be removed from his previous state’s voter registration list.
