    CRNA's Supervision of AA's Archived Message

    The Florida Board of Nursing has issued a final order on the declaratory statement petition filed by Paul Dow, CRNA, concerning the supervision of AA trainees by CRNAs. The Board of Nursing concluded that CRNAs are not authorized by law to supervise AA trainees, and that such supervision would be "assisting or advising an unlicensed person to practice" contrary to the supervision requirements in the law governing the practice of AAs. The AA law requires that licensed AAs practice under the direct supervision of an MD or DO anesthesiologist. The Board of Nursing's final order states that "it would appear to be contrary to [the AA law] for anyone other than a physician to supervise an AA, much less an unlicensed AA intern or trainee." The final order further states that supervision of an AA or AA trainee is beyond the scope of a CRNA's license and would violate the Nurse Practice Act.

    Although a declaratory statement legally applies only to the petitioner in his or her specific circumstances, such orders are a clear reflection of the Board's interpretation of the law. Final orders on declaratory statements are published on the Board of Nursing's website, and are frequently consulted by practitioners (and their lawyers) for guidance on specific issues.

    This final order will provide a clear legal basis for Florida CRNAs to refuse to supervise AA trainees, and will provide guidance for hospitals where AA trainees are assigned.
