Certainly not ideal but it means we're still out of the relegation zone and I would be surprised if we didn't quickly gap both of those teams.
That being the case, hard to see how we’d appeal the judgment for the second charge (which represents the sane set of numbers plus one year). There *might* be an argument for a lesser sanction with the second charge tho, as we clearly made efforts to reduce spending during the final years assessed (which was noted by the PL in our appeal).
I’d expect another six points to be deducted for the second charge…but could be four or five, if they feel we were trending in the right direction. The good news is Forest should receive at least the same, as their breach seems more egregious.
But presumably the focus of our appeal was that it was disproportionate.
The focus of our second appeal should be that it’s double jeapordy.
I sincerely hope that the second charge anticipates future appeals and to me it seems that Forest should now get a 6 point deduction and we should get 2, given that we can only be tried on a proportion of the period in question.
