that no one should be able to terminate the life (beating heart, brain waves) of a baby except perhaps for saving the life of the mother. There's nothing in the Constitution that says the SCOTUS can't interpret it this way, but is the issue they have no enforcement power? How can they require anyone to do anything then? Previous Message The distinction is perhaps important to your question. I don't think the S.Ct. could "outlaw" abortion but for purposes of your hypothetical, I will assume that it can.
