In fairness, when it comes to the question of breaking up the state, there are legitimate legal questions to be had, and I had long wondered when they would come to the fore.
To wit: the Constitution clearly lines out the process to break a state off of another pre-existing state. Amongst the hoops that have to be jumped through is the consent of the state legislature.
As this breakup is to be done by referendum, it becomes an open question as to whether or not this counts as legislative consent. The argument can cut both ways.
On one hand, it is the people directly deciding the issue, not the legislature. Thus, one can argue that the proper forms are not being adhered to, and thus the entire exercise is illegal.
On the other hand, one can argue that by the very act of signing off on the creation of the referendum process over a hundred years ago, the state legislature gave its continued consent to whatever the outcomes of said referendums may be.
In truth, it is a question that should be decided by the courts once and for all. As such, I look forward to the trial.
