Largely because the vermin who commit crimes plead out so they can get their three squares and a nice cot to sleep on. No, largely because of mandatory minimums and the prosecutor being the only person having any say in what will be charged. Make the prosecutor work for it, and he's gonna throw the book at you. If I recall correctly the ACLU estimates that more than 10% of people in prison pleaded guilty, even though they weren't, to serve a much slighter sentence than they might have faced otherwise. Couple that with public PRETENDERS who have large caseloads because most PEOPLE can't afford their own lawyers.
