I think the rules were sufficiently clear cut that Everton could have sued them successfully
Which is why they begged UEFA to come up with a solution.

The FA lobbied UEFA to give England 5 slots, and they agreed. If they hadn't, who's to say that the FA wouldn't have followed the precedent set by the Spanish league who demoted Zaragoza to 5th to allow Real Madrid to defend their title in 2000?
