Not surprisingly the problem in this case seems to have occurred when the EFL decided that spying was to be the subject of disciplinary action, but then seemed to think that would put an end to it whilst not setting out what those sanctions would be if a club did go against the rule.
The same complaint was made about the PL profit and sustainability rules. To which I think the response from the PL was that if the punishment was laid out in detail for certain levels of losses, clubs could form the view that it was worth breaking PSR if they felt the advantage it game them outweighed the punishment. Not saying I agree with it, but that’s the reasoning I think. Also the punishment surely very much depends on the context. You can’t really disqualify all clubs that break rules on spying from a play off final!
