    'Cooperation' with investigation

Posted by HH on 2/5/2024, 16:26:56

Just seen how the FA praised Tonali for his cooperation with their investigation into his gambling. Similar to how the PL were lenient on Forest for their cooperation.

Yet when we cooperated by self reporting and pleading guilty for an irregularity, where no one made any illicit money and one which was carried out under a previous regime, we have the fucking book thrown at us with a 10 point deduction?

I get it was 16 years ago, but it's still fucking bewildering and draconian what the FA did to us.

In a later similar case, the panel hearing it asked the FA whether there was any sentencing precedent. The answer was that there was a precedent, namely our 10 point deduction but that on reflection the FA now considered that penalty to have been to severe and that a fine was more appropriate!!!
The club involved was, I believe, Watfraud.

Just re-reading about that one. Baffling beyond belief.

At the hearing the FA not only did not seek to justify the penalty imposed on us, they went further and admitted that they should only have demanded a fine as a penalty. If you also remember, when we were given our 30 point total deduction, we were told that getting our golden share back after going into liquidation was on condition that we did not appeal the penalties imposed on us. That of itself was potentially legally challengeable but understandably 2020 wanted to play safe and ensure that the club continued to exist by accepting the terms imposed.

2020 made a mistake in accepting it.

            Hindsight is easy though.

2020 weren't allowed to appeal either the fa or efl

It was a real "stick or twist" moment. An appeal against the 10 point deduction could have caused the League to withhold the golden share and even a delay in handing it over could have been fatal to our existence. Similarly a legal challenge to the requirement not to appeal not only may have failed but also may have fatally delayed the return of the golden share. 2020 in my view did absolutely the right thing by playing it safe. I am still just outraged at the behaviour of the authorities in seeking to prevent any appeal against the points deductions. If the deductions were appropriate, they would be upheld. If they were not and different penalties were substituted, that would simply reflect the justice of the cases and demonstrate what penalties should have been imposed. Threatening 2020 as they did was just bully-boy tactics.

We did appeal the ten point deduction.

I am very firmly in the never forgive, never forget camp . . .

But, we certainly need to let go of the idea that there will ever be any logical explanation for what was done. There never was one and there never will be one.

Which is exactly how see it. Though what really sticks, even after all these years, is the ‘no right of appeal, judgment is final’ line. If they were that confident in their judgment then why did they have to insert that clause?

It continues to stink, even after 16yrs. I won’t forgive either.
