    The premier league said that:
    Everton FC and Nottingham Forest FC have each confirmed to the Premier League that they are in breach of the League’s Profitability and Sustainability Rules (PSR).

    So both clubs admitted to them that they are not compliant.

    The appeal board determined that fines, transfer bans or suspended points penalties are insufficient: and so a precedent has been set and the regulations have acquired some teeth. “Only a points deduction is appropriate for a breach of rule E. 51,”

    So it surely has to be six off for Forest and maybe more for repeat offender's Everton.
    If it is six, would these clubs even bother appealing as it is unlikely to be successful given the precedent already set.

      This pretty much sums it up. The last 5 mins talks about forest and Everton. Essentially, with appeals (which are expected) it will be dragged out until June but still valid for this season nonetheless

        The issue with Everton is because it's done on a three-year basis, they've already been punished for two-thirds of the time covered in this second charge.
        So, it's not as simple as saying they're repeat offenders - you could claim that if they got six points again they're being punished twice for breaking the rules in two of those years.

          Where did you get that info from please?

          The PL handbook doesn't state that the second offence will be treated more leniently. I guess this is the first time the rules have been used for a repeat offender so there are no previous cases to compare. So the outcome will be interesting. My own view - and more of a deterrent - is that a second offence should be treated more harshly, not less.

            It's a rolling three period so two of the years were in the previous three year period which is Everton's claim as a mitigation in deciding the penalty - not saying that I agree with their argument but...

            In fact, because of two years being taken together due to Covid, I think that they might argue that three years out of four have already been punished.

                  I think the issue is that it is a rolling three year period so no, they have not technically been punished already.

                  Not looking at the specific numbers of the Everton case but hypothetically, you could be in a position whereby you lost £100m in Year 1, £10 million in each of year 2 and 3, giving you a rolling number of £120 million such that you are in breach. If you in year 4 you again spend £100m, you are once again in breach but to argue that your two 'quiet' years have already been punished should surely not be a defence.

                  In a normal situation, I would say that an increased penalty should be issued for a repeat offender but given the nuance of this year being 'transitional' and having two years worth of accounts being considered in the same season, I think that would be harsh on Everton. Whilst yes they knew they were in breach the first year when they did it again, they did not know the penalty. To then say, well you have not learnt would be a tad harsh.

                  Yep. I get the feeling that even the Prem are fed up with Everton

                  But on the other hand, they won't want to upset precious Liverpool fans (and Sky TV) by taking their Merseyside Derby away from them

                  We really do have useless governing bodies in football.Its not just the UK it’s all round the world.
                  The UK ones are on really thin ice and if they don’t show proper leadership it could be taken away from them which imo would be a good thing.
                  The EPL are currently crapping themselves as cant reach agreement with the efl on distribution of funds…another nail imo which hopefully should make the useless twats more decisive and do the right thing.
                  We live in hope ….if they gave us our points back we would be in Europe 😂😂
