Everton + Nottingham Forest expecting to be informed on Monday that they’ve been found in breach of PL profitability & sustainability rules for 3yr cycle to June 2023. Both have prepared mitigation & will launch robust defences @TheAthleticFC #EFC #NFFC

Saw a thing today that Kieran McGuire (think that’s his name) says Everton should be okay as they can count Gordon’s £50 million sale in this year’s numbers. Looking dodgy for a forest though…

How exactly does one mitigate breaking the rules?
If one can mitigate them surely the rules are superfluous?

I would suggest that if the rules are poorly written then, it might be perfectly possibly to circumvent them for ones own gain.

Any other accountant on the forum would understand that. It is what allows us to mitigate our clients tax liabilities.

One should never blame the accountant or their client for the inadequacy of some Whitehall boffin who drafts the legislation. Undoubtedly they would and clearly do struggle with English Key Stage 1.

I'm not sure about that Alan. Technically you're accurate but I've always thought that with both the law and accountancy there should be some sort of moral compass. Sadly, throughout history there is a lack of that.

The only interest, in most cases, seems to be in making money

Such a disappointing/appalling case that isn't it. An institution I personally would have instinctively thought honourable but in fact rotten to the core. I don't ever wish to be 100% cynical, but there are times....

I used to work with a chap who had emigrated to New Zealand and came back after 3 or 4 years. Prior to his emigration he was a PO auditor. It was about 2011/12 and I must have seen/heard something about the scandal, and he defended the Horizon system. I then questioned him about how come so many decent, honest people could suddenly become dishonest. There was not much of an answer to that. We were not talking about hundreds at that time, at a guess about 50ish I would think. Having seen the way people in positions behave over a number of years, I am appalled at the behavior of senior management. Out of touch with reality

And I sincerely hope that those in management positions get justice served to them - especially given the injustices they've knowingly dished out to good honest people.

Absolutely no surprise. I often hear that these titans of business are paid the big bucks because of the levels of responsibility on their shoulders, but it's responsibility that they invariably shirk.

I'd stake a decent sum of money that not one single individual will face any criminal censure or lose a single penny as a result of this affair.

Absolutely. This "talent" we are paying for is basically having the brass neck to scoop up millions in cash while behaving in appalling ways as often as not.

You're analogy is poor. The law is very specific on drink driving. It is not open for interpretation in the the simplistic manner you describe.

I realise that Alan, but that's exactly my point.
                            Are they rules or advisory?
If the former then there can be little difference between those and the law.
Mitigation may be used to lighten the punishment, but, surely, it can't be used to avoid punishment completely?
