Whilst I am not in favour of capital punishment, I'm not sure this particular example is quite the right argument against it. Surely there would be a high bar set for the evidence required to apply that sentence, which (from what I have read) would not have been met in this case? I suspect that it would actually be used in relatively few cases, i.e. the worst of the worst, where there is no doubt whatsoever (caught red handed). Like I say, I'm not in favour but I think the argument against it needs to be made in other ways.
