This is what was filed with the FCC this week. They could continue to operate the FM translator with FCC permission which would easily be granted because this is a unique case. Normally the commission would not allow a station to continue to operate the FM translator when the AM is off the air, but they would have had no trouble getting permission in a situation like this if it were true. This is an extremely convenient reason for the station to go dark while they try to sell it, and once again it is obvious that if this were the real reason for the station going dark they would have immediately notified their listeners in every way possible as to what was happening. In the purchase agreement of the station there is a clearly outlined description of the real estate and nowhere is it mentioned there is an easement with the ITHA conveyed with the sale of the station. When situations like this are real they are very clearly outlined in any sales agreement because it would be such an important factor. Letís see if the commission examines this agreement.
WCKG'S TRANSMITTER SITE INCLUDES AN EASEMENT UPON PROPERTY MAINTAINED BY THE ILLINOIS TOLL HIGHWAY AUTHORITY (ITHA). A PORTION OF THE WCKG ANTENNA GROUND SYSTEM WAS BURIED UNDER THE REAL ESTATE GOVERNED BY THIS EASEMENT (THE TRANSMITTER SITE IS IN CLOSE PROXIMITY TO THE JUNCTION OF THE RONALD REAGAN MEMORIAL TOLLWAY (I-88) AND THE TRI-STATE TOLLWAY (I-204).
ROAD CONSTRUCTION AUTHORIZED BY THE ITHA TAKING PLACE THIS SUMMER HAS TAKEN PLACE ON AND ADJACENT TO OUR EASEMENT AND HAS RESULTED IN SUBSTANIAL DAMAGE TO OUR ANTENNA SYSTEM, WHICH HAS IN TURN RESULTED IN DAMAGE TO THE WCKG TRANSMITTER. AS A RESULT, WE HAVE TEMPORARILY DISCONTINUED BROADCASTS OVER WCKG UNTIL THE ITHA CONSTRUCTION HAS BEEN COMPLETED AND WE CAN MAKE REPAIRS TO OUR GROUND SYSTEM AND TRANSMITTER.
THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY WOULD BE SERVED BY A GRANT OF THE REQUESTED SPECIAL TEMPORARY AUTHORIZATION.
