CLAY COUNTY, Ill. (WICS/WRSP) ó A judge has ruled in favor of Rep. Darren Bailey, R-Xenia, in his lawsuit against Gov. JB Pritzker regarding whether Pritzker's stay at home order exceeded his authority. |
Bailey filed a lawsuit in Clay County Circuit Court on April 23, claiming Pritzker had exceeded his authority and violated the civil rights of Illinoisans by issuing and extending the stay at home order.
Clay County Circuit Court Judge Michael McHaney ruled that the 30 days of Pritzker's emergency powers lapsed on April 8, so any executive orders related to COVID-19 in effect after this date are void.
ďDespite the governorís attempts to move the lawsuit to multiple courtrooms, including a federal court, the rule of law prevailed, and the rights of Illinois citizens were upheld today," Bailey said. ďThis is a good day for accountability.Ē
