1) If the punishment is cruel and unusual, and against the Constitution, then what a fine Federal Judge he is, making such a suggestion that law abiding, society defenders, should be subject to a punishment he says is unlawful for convicted felons.
2)I worked for TDC for over 32 years, I DID stand and work in the same environment. I am proud of it and don't forget, Texas has been hot for 100's of years.
3) One of his so called violations came when the inmates were moved to avoid hurricane flood waters; he said he didn't care about that, showing lack of common sense (I am sure failure to protect at that time would have been seen as retaliation and deliberate indifference.)
Federal Judges have been using their power to legislate and this is showing their personal bias, not the rule of law. SCOTUS is consistently overturning the lower courts decisions; this one should have been taken further; but alas, the Tax Payers continue to be victims.
