The key seems to be that they believed his evidence that he didnít have a clue what a nazi salute was (!) and the context provided by other photos of him on the pitch shouting in the same way.
The panel was chaired by a senior QC so it wasnít lightweight but itís quite interesting (and I think a bit unusual) that the decision was a majority rather than unanimous. One of them didnít believe him!
