I will have to agree with Yoko in that the designs don't look the same at all. btw you can't necessarily copyright a band name.. You can (and should) copyright all your music compositions.
However, you certainly can TRADEMARK a band's name. I did that with mine a few years ago:

It's kind of expensive, but that way you have legal rights to it. Just go to the US trademark office, submit the forms, and you're good to go. I know of other bands and such who have trademarked their names.
