Here is a lesson learned the hard way, and I'm posting it here so you don't have to.
Anyone shipping a bike or anything they would like to see again should google "carmack amendment." Very few attorneys know about it as it is a federal law so if they tell you different than below I assure you they are wrong.
This nasty little law basically says carriers are not liable for theft, fraud, misrepresentation, gross negligence or any other normal right you have as a consumer. Thus you can not sue them even if you video tape them smashing your bike into bits with a hammer or giving it to their nephew as a christmas gift.
So how do you protect yourself? Why. . . buy their insurance, of course! Does this seem like a scam, or what? I will keep this brief and not pontificate over the inequities of this federal law or the lobbyist that paid our politicians to create it, but if you get a beer in me I would be happy to elaborate
As a side note, homeowners insurance usually covers "lost" packages so you could insure up to your deductible and be 100% covered that way and give less money to the carriers.
