The answer to all of your questions lies in the workings of Responsible Government, which we have had for over 160 years. Responsible Government means both that Lord Byng was entirely correct in what he did in 1926, and that the Queen or Governor-General must leave it to the courts to rule on the constitutionality of any law that has been duly passed by Parliament.
