                    I think it’s fair to say nobody knows (except her and a few close people ) if she has broken the law.
                    However I would disagree that she hasn’t done anything wrong.its very clear that she moved into her husbands house after her children were born and therefore this would become her main residence. The fact she continued to pay her council tax on her property ( which she should have declared as empty and a second property ) means it remained her main residence for cgt purposes.
                    The amount she would pay is pretty small as it’s only on the gain from when she wasn’t there….nevertheless she is certainly guilty of incompetence if not breaking the law.

                      That doesn't stand up to the terms of the legislation. Based on numerous witnesses, she had moved in with her husband so they can only have one PPR between them for CGT purposes and this is where I think that she is going to have a problem. I would be interested to see the reasoning behind the advice she claims to have received.

                      CG64525 - Private residence relief: only or main residence: two or more residences: nominations on marriage or on registering as civil partners
                      S222(6) TCGA92 sets out that spouses or civil partners who are living together can only have one main residence between them for the purpose of private residence relief. If when they marry or register as civil partners they each own a residence and they continue to use both as residences, they can jointly nominate which is to be treated as the main residence. The two year period for making the nomination commences on the date of marriage or the date of registration.

                        Agreed and that was my point.
                        The period from when she moved in with her husband to sale should attract cgt.
                        I suspect the advice she received may have been based on “ providing you are still living there “ nudge nudge , wink wink , say no more!!
                        Is it the crime of the century …absolutely not but when you throw so many stones you have to make sure none can come back.

                          Well, as her gaffer made it to the very top of the legal profession and has no doubt been providing her with advice (and offered to resign himself when subject to a very public enquiry) I’d say, given her comments on the matter that she feels she’s on pretty solid ground.

                          I just wonder if the Daily Mail has a fortnight’s worth of consecutive front page headlines on it….
