    Advice required

Posted by PHS on 17/3/2024, 21:17:06

As this is such a diverse forum!

An OAP friend who only receives state pension income has had his bank account emptied by a drug addicted relative and now needs to sell his deceased wife's jewellery to be able to pay rent and council tax next month.

    1. As he is very unlikely to report the theft to the police, would the council listen sympathetically to the reasons why the payment cannot be met or would be late? If not, are they more likely to view it differently if there was a reported crime involved?

    2. He hasn't been late with the rent in over 8 years (same landlord and letting agency for that duration) but would one late payment of the rent immediately allow the landlord/letting agency to issue an eviction notice?

    3. Any suggestions where he may get the best valuations for the jewellery so that he doesn't have to sell all of it to the most convenient bidder?

    Thanks in advance.

      3. Don't sell any jewellery in Luton Town centre, shop around find out the current scrap gold price and weigh it yourself, you probably won't get more than scrap value, if there are larger diamonds or large stones, rubies, sapphire and emeralds there may be some value. Hatton Garden next to Farringdon can sometimes give good money

His council likely have some kind of discretionary emergency hardship fund which can help for things like this. It will take probably a few phone calls and a lot of patience to find the right person at the council to help though

Legally the landlord could start proceedings, but if he is a good tenant it is unlikely to be in their interests to do so. It is more hassle to evict him and get someone else in, so they will probably be sympathetic if you explain the situation.

The council will definitely be more sympathetic if there is a crime involved, but they are not likely to start proceedings on one late payment, especially if your friend is intending to pay asap.

Is the relative likely to steal more from him? For his own protection you should try to persuade him it is in his best interests to report the relative. It might also be the wake up call the relative needs to stop behaving like a scum-bag.

First thing, speak to the landlord. Council tax less likely to be sympathetic but still worth a try. Definitely report the theft, if not the thief, it will help with at least one of the aforementioned.

                Cheers, Jim

I think the council would require proof of the crime.

Agreed, police need to be informed. Get a crime number. The drug addicted relative will see him as an easy touch otherwise and repeat the performance.

CAB is the other thing to approach.

If the bank account has been emptied fraudulently he should go to the bank and try and get a refund. All banks subscribe to various compensation schemes

RK.Saw a couple of your mates, (could have been family), flying around over Offley hill as I drove to the game yesterday.

There are several which fly over Blows Downs and one has been observed over Kenilworth Road during a match.

They also frequent the skies over Houghton Regis.
