    ATOL Protection - help!?

    Posted by C93 on 7/6/2019, 23:42:35

So, my bird spent £5,000 on a holiday to St Lucia for 2 weeks. We’re meant to be going on the 16th June but the holiday company we went through have gone tits up. Our flights with virgin are still booked (despite going through the holiday firm) but our hotel reservation has been cancelled and also the transfers.

What’s the crack and where do we stand? What would you recommend?

The firm was a company called The Holiday Place.

Contact JVS if anything gets messy - on already if further advice needed.

People really need to wake up to benefits of paying by CC for things like this, much better protection. It’s not about debt as you pay the balance off straight away - just much superior cover/comebacks.

Hopefully things are straightforward for you

Same as, except we were going to Cuba in August. They're ATOL affiliated so you're covered and if you paid by credit card they'll stump up. Just a ball ache really.

What if we paid on a debit card...... ?

ATOL should pay up anyway - Section 75 for credit cards is a separate option because you would have had a contract with the credit card company so they would be liable - doesn't apply to debit cards. When booking a holiday it can be worth paying part (the deposit ?) by credit card as this then covers you for the full amount (subject to a number of conditions.

For debit card payments, chargeback may be an option (not sure) but, hopefully, you won't need to go down any of the alternative routes.

I got my money back from the bank when I paid for furniture on a debit card from A5 furniture before they went bust. But you're right (of course) it's far dodgier ground than paying by credit card.

ATOL protected. You're fine. We approached the CAA first. The Holiday Place should be in touch with you, we were contacted today.

We haven’t been contacted apart from by email on Tuesday to tell us about it! No one else has been in touch yet!

Only heard from The Holiday Place this morning. The CAA told us about it on Wednesday. Check your spam box. I know it's shit but you're protected, just need to look for an alternative, you're flights are still valid just need to look for alternative accommodation. Your rooms may still be available at a cheaper rate direct with the hotel. Good luck.

Thanks mate - just contacted the hotel and they want £3500 for the same room & dates!

                  Mental!

I would suggest that you start by contacting ATOL as soon as possible for advice.

Two other things to consider if you don't get anywhere through ATOL

              1) Presumably you have holiday insurance - put in a claim and they will try to recover any money that they have to pay you.

              2) Did you pay any part of it (the deposit ?) by credit card - if so, put in a Section 75 claim.

Didn’t pay a deposit just paid it all in one lump sum!
