Perhaps I shouldn't have said missused; Merriam-Webster (http://www.merriam-webster.com) gives both a first definition, "of, relating to, or consisting of words" and a third definition, "spoken rather than written". However, real estate transactions deal with at leasttwo things that are not "of, relating to, or consisting of words", plats prepared by surveyors, and seals. So it is better to choose the unambiguous "oral" when we want to indicate something is not in writing.
