in wi the rules and laws are not totaly clear on whether we notarize capacity or not....in conference with our sos it is up to the notary to decide if you leave it in or cross it out and initial.....i always cross out capacity or how they hold title all of the time.....the notarial certificate is your confirming under oath that what is in the certificate is true....the notary law institute says that the notarial certificate belong s only to the notary and that the document maker really has no right to fill it in....evn tho the cert is on the document it is considered to be a certificate in and of itself and notpart of the document...in short i always cross off anything but the names as i have id them and have never had one returned....take that back had on from a mortgage banker one time by phone and i told them to call the sos and they did and found out i was right and backed off.... jmho.....i am not a lawyer and this is not to be cionstrued as legal advice...yada yada yada...
