The filing may be unrelated. Someone with a Fictitious Name statement (dba) filing can fight a state filing if they can show the filing will hurt their name/ business status.
I did the same for someone who lost the Trademark fight, and attempted to do an end run by incorporating in CA, where I'm located. There long out of business, but unfortunately I must now deal with the bad rep they created in their demise with my trademarked business name.
The only companies who register with the SOS in CA or those who incorporate, or are LLC's. General partnerships and Sole proprietorship's do not register, they just file (or don't, but should) a dba with their local county recorder/clerk.
