yes thank you! I am paying attention to proper ID which is my main concern. I also always call to see method of correction is and how they want to deal with the problem. YES again, lenders do seem to be saying whatever they want and hope they can intimidate the notary into it.

: The conclusion may not be true that 'FHA
: loans have to be drawn..." But
: that doesn't mean that isn't what she
: was told.
:
: I talked to an escrow company a couple
: weeks ago because the borrwer's ID did
: not match the documents on a reverse
: mortgage. I was told specifically
: that the docs had to be drawn in the
: name on the Social Security card. It
: didn't fly, but that is what I was
: told. In my case, the borrower went
: and had her driver's license changed
: to her married name, which is the same
: as on her SS card and we signed a week
: later with new docs. The point is -
: these lenders are saying whatever they
: want.
:
: I agree that she could have asked
: about having the borrower sign with an
: aka, which is what I always ask. In
: my case, however, they wouldn't allow
: it, so we adjourned.
:
: While it makes sense and one would
: think that docs are drawn the way
: title is held, that may not always be
: the case, at least from the comments
: borrowers have made at closing. Of
: course, what would really make sense
: is that in the original purchase, ID
: is checked and the original Deed is
: drawn in the name on the ID. That
: would take care of the problem of
: someone who buys a house in their
: nickname, but have ID in their given
: name, which ultimately leads to ID
: issues.
:
: Of course a notary can't dictate how
: things are done, but it sounds to me
: like this notary is paying attention
: to proper identification.

: "Was told by a bank president
: this
: week that FHA loans have to be drawn
: in the name that appears on the
: borrowers soc sec card,"
:
: This is not true - docs are drawn the
: way borrowers hold title and, IMO,
: makes this following statement "I
: had them re draw docs so that is
: eliminated the name that was not on
: the ID. " incorrect too - you do
: not dictate how docs are drawn -
: that's up to title and lender - unless
: you've done a title search and
: determined how title is held you have
: no authority to say how docs should be
: drawn. You can't just randomly
: eliminate names from title.
:
: IMO, you could have requested they be
: allowed to sign using a/k/a and your
: certificate would reflect the name on
: the ID. Absent that authorization,
: refuse the job. You're correct in
: that the Signature/Name Affidavit is
: not acceptable ID for a notary and
: I've lost track of how many times I've
: debated this with title companies.

: Was told by a bank president this week
: that FHA loans have to be drawn in the
: name that appears on the borrowers soc
: sec card, and that I HAVE TO notarize
: it in that name, even tho it is MORE
: than what was on the driv lic. I
: refused. Soc Sec cards in Calif are
: NOT acceptable ID. THey (lenders,
: title cos, LA's ) have all told me
: that its ok because its both ways on
: the sig affidavit and it will have to
: be oversigned because everyone under
: the sun wants it that way. Not so.
: Its ok with THEM but not for the
: notary. THe name on the ID must be the
: one used on the sig affidavit saying
: that they are also the 'more than
: name'-not the other way around. No
: matter whats on the sig affidavit the
: notary is not covered for notarizing
: the loan package in an oversigned
: name. I had them re draw docs so that
: is eliminated the name that was not on
: the ID. I had to fax them pages out
: of the law primer etc. They even had
: copies of the borrowers IDs way in
: advance. They also told me that I was
: the only Calif notary who they ever
: had a problem with which tells me that
: many are being bullied or just dont
: know not to notarize in names that are
: more than whats on the ID.
