yes two credible witnesses with ID.But some lenders /title co's wont accept that. Our Acks have a space on the bottom to list capacity. Our acks have an added line on them I certify under PENALTY OF PERJURY under the laws of state of cal that the foregoing paragraph is true and correct. What we are swearing to is the ID of the person who appeared before us. ID is proven on jurats too.

: What you just said may be state
: soecific for CA. In AZ we are allowed
: a credible witness.

: No matter how the name appears on
: title
: search, if that name is more than or
: not the same as the ID, you are
: committing a fraud by notarizing in
: any name that is not on the ID or MORE
: THAN what is on the ID. The reason it
: got recorded NOT matching the ID was
: because some notary notarized it that
: way in the past. Should never have
: happened. I am just trying to help
: other notaries to stay out of trouble,
: and get us in sync so we can make the
: industry more efficient.

: "Was told by a bank president
: this
: week that FHA loans have to be drawn
: in the name that appears on the
: borrowers soc sec card,"
:
: This is not true - docs are drawn the
: way borrowers hold title and, IMO,
: makes this following statement "I
: had them re draw docs so that is
: eliminated the name that was not on
: the ID. " incorrect too - you do
: not dictate how docs are drawn -
: that's up to title and lender - unless
: you've done a title search and
: determined how title is held you have
: no authority to say how docs should be
: drawn. You can't just randomly
: eliminate names from title.
:
: IMO, you could have requested they be
: allowed to sign using a/k/a and your
: certificate would reflect the name on
: the ID. Absent that authorization,
: refuse the job. You're correct in
: that the Signature/Name Affidavit is
: not acceptable ID for a notary and
: I've lost track of how many times I've
: debated this with title companies.

: Was told by a bank president this week
: that FHA loans have to be drawn in the
: name that appears on the borrowers soc
: sec card, and that I HAVE TO notarize
: it in that name, even tho it is MORE
: than what was on the driv lic. I
: refused. Soc Sec cards in Calif are
: NOT acceptable ID. THey (lenders,
: title cos, LA's ) have all told me
: that its ok because its both ways on
: the sig affidavit and it will have to
: be oversigned because everyone under
: the sun wants it that way. Not so.
: Its ok with THEM but not for the
: notary. THe name on the ID must be the
: one used on the sig affidavit saying
: that they are also the 'more than
: name'-not the other way around. No
: matter whats on the sig affidavit the
: notary is not covered for notarizing
: the loan package in an oversigned
: name. I had them re draw docs so that
: is eliminated the name that was not on
: the ID. I had to fax them pages out
: of the law primer etc. They even had
: copies of the borrowers IDs way in
: advance. They also told me that I was
: the only Calif notary who they ever
: had a problem with which tells me that
: many are being bullied or just dont
: know not to notarize in names that are
: more than whats on the ID. Title can
: also make a grant deed and a WATA (who
: also took title as). They can do this
: or re draw otherwise I am not
: perjuring myself by notarizing it.
