Was told by a bank president this week that FHA loans have to be drawn in the name that appears on the borrowers soc sec card, and that I HAVE TO notarize it in that name, even tho it is MORE than what was on the driv lic. I refused. Soc Sec cards in Calif are NOT acceptable ID. THey (lenders, title cos, LA's ) have all told me that its ok because its both ways on the sig affidavit and it will have to be oversigned because everyone under the sun wants it that way. Not so. Its ok with THEM but not for the notary. THe name on the ID must be the one used on the sig affidavit saying that they are also the 'more than name'-not the other way around. No matter whats on the sig affidavit the notary is not covered for notarizing the loan package in an oversigned name. I had them re draw docs so that is eliminated the name that was not on the ID. I had to fax them pages out of the law primer etc. They even had copies of the borrowers IDs way in advance. They also told me that I was the only Calif notary who they ever had a problem with which tells me that many are being bullied or just dont know not to notarize in names that are more than whats on the ID.
