    No they disputed the extent of the breach, said ti was much less than £19.5m. Alternatively they said there was mitigation.

    The commission found the breach greater than admitted.

    It was only in our Amended Reply that we admitted any breach. Prior to that point we'd denied breach.

    Mitigation wouldn't absolve us but would reduce penalty. Perhaps most will be familiar with it in criminal cases where, in mitigation, the barrister/solicitor-advocate will say that the criminal convicted had a terrible childhood, was under stress, goaded, influenced etc to have a sentence reduced.
