I would have to admit a prejudice for Dr. Weil's contributions to the integrative medicine field. He is a pioneer in integrative medicine and an internationally respected authority in the concentration.
However during any epidemic or pandemic many folks "come out of the woodwork" with a host of treatments. Some may work..others won't. The concern that Health and Human Services may have is that as the current H1N1 virus spreads taking some of these "remedies" could delay proper scientifically approved treatments and the virus numbers would continue to expand in populations.
In order to deal with the current situation the FDA has been included as an enforcement arm. It is an "all or nothing" approach and unfortunately some significant remedies such as Dr. Weil's "immune boosting products" have been called to task. Earlier the issue of cytokine involvement in individuals with heightened immune response caused some concern.
According to the FDA letter it does seem to open the door to an "Emergency Approval" of sorts. I do not see any referral to "gunpoint". The terms seizure and/or injunction do not include such drama.
Dr. Weil's reputation in the field of Integrative Medicine stands on its own and I feel a mutually acceptable agreement will be reached.
