It is perfectly FINE for them to NOT hire smokers as long as the policy is uniformly enforced for all people and is constantly upheld.
If there WERE smokers at the compnay- then you'd have something.
My employer asked me if I smoked (I don't) and there are no smokers at the office and there never will be.
