question for all smokers in this joint

I was applying for a job im in miami florida... i was doing great in the interview and i know i qualify for the position, but when the lady asked if i smoked and i answered yes i was immediately unqualified for the job and she rejected me, mind you this is a graphic designer job and i got plenty of designer buddies who happen to smoke, i felt discriminated for the first time in my life due to my decision to be a smoker which to me has nothing to do with my job performance, has anyone ever had this happened to them, and what would you do this obviously is not a equal employer... can i go ahead and hire a lawyer for discrimination... im really upset and feel discriminated... all comments welcomed it seems this is something illegal under the law,... cheers Big Boi ( one pissed off smoker )
