A press release from the BHA:
The Disciplinary Panel of the British Horseracing Authority on 13 August 2009 held an enquiry to consider whether or not the West Street Tickham Point-to-Point Committee, had committed a breach of Regulation 61(iv)(f) of the Regulations for Point-to-Point Steeple Chases, in the light of paragraph 6.7 of the Instructions for Point-to-Point Steeple Chases, in respect of their failure to have somebody manning the gate into Bimbury Lane (the main car park exit) at their meeting on 14th March.
The Panel heard evidence from Ms Pam Baker, a member of the West Street Tickham Point-to-Point Committee, that was legally represented, and Mr Colin Squance, the South East Area Chairman. The Panel also considered written submissions from Ms Tabitha Cave, on behalf of the Point-to-Point Authority.
The Panel found that the gateman on the perimeter fence had left his position after the 6th race. This would have been the final race but a 7th race was scheduled at short notice by the splitting of the Open Maiden into two divisions. The failure of the gateman to remain in post for the last race, in the circumstances of this case, did not satisfy the Panel that the Point-to-Point Committee had failed to properly consider the adequacy of the venues perimeter security.
Having considered the evidence, the Panel found the West Street Tickham Point-to-Point Committee not to be in breach of Regulation 61(iv)(f).
