Depends on your definition of distribution. If you are planning to sell your game, then there is a possibility that you may run into some trouble. However, if you are just going to put the game on the internet for free or give it to friends then it isn't that big of a deal. I feel that you should always give credit where credit is due, though. Most likely if you got the Midis from a public domain you don't remember the composers, but atleast mention the website in your credits or something? It's more a matter of morals than you getting thrown in jail.
