I own a Chadwick by FLeetwood. I am in the same general boat as the others. However, I am afraid that I am going up against a giant, and I don't have the leaverage needed to conquer. You see I assummed this home and land. I never had any dealings with Fleetwood, just a personal party.
My family and I have suffered greatly over this home, and it all started with a hell of a investment for such a young couple and their "first" home. We should of known that it was going to me a "moneytrap" the day we bought this place. Returned home from the title company signing escrow papers, to the water company at our front door. Come to learn our main broke under the home several months prior, and for almost two solid months we were loosing 1698 gallons a hour or something close to those numbers. So you can imagine what type of mess that would make under the home. OVER 65 days solid. And so it has created a sink whole under one side of the home, and a 400.00$ water bill for ONE MONTH! That was interesting, and has only snow balled since that day. The house settled so bad after the water repair, we had to have our foundation redone. Once that was chaos was at ease, we soon found that the windows in the home were say JUNK! Due to the settlement of the home, as one would think, our window seals, and windows acted more like screens. Mind you I live were the normal winter tempatures average 10-25 F daytime and around -15 degrees at night. I have two children under the age of three at that time. So over $10,000.00 spent in repairs to only the "living area" windows, no bedrooms, we are no longer home sick eskimos.
Anyhow just as same as the rest I can go on and on about the million and one tiny things, starting from the very day of ownership, that adventually created a total disaster.
I am now in the stages of foreclosur on the home. Not because of personal financial decissions, but because I took the trustworthy word from my mortgage company.
I called them back in April to tell them this home is INFESTED with mold. You can literally find a new patch up my walls every day! Just poof, black spots the size of silver dollars or bigger all over. We have had hell trying to get resolution to this, but due to the cause determined as "seppage" we have been standing at this dead end for some time.My homeowners concluded without any douts that it was all due to manufacture defect in design of home. Same with the Mortgage insurance inspecter, and the inspector I hired personally. My mortgage company told me back in April that they could not offer us any hardship package, or aid in repairs because we are current on payments. That only if you are 90 days in default will you be given the oppurtunity to apply for the harpship workout solution. So right then I told her what BS that was! A person who pays their bills gets bent over, meanwhile the ones who don't are handed solutions! Well I gave my offical notice I would not be making any payments for the next three months, however I am not intitled to because of the unhabitable living environment.
Well anyhow in the end, they closed the insurance claim without my approval stating they could not get the occupants in the home would not allow them into the home to inspect the mold. Well all this being a complete crock of shit, I have been here the entire summer waiting for the call from Safegaurd Inc, and never recieved ONE.
Well this is what it all boils down to now. To repair only the interior of my home to prefungus infestation condition, it will be over $28,000.00. Mind you this is a 1994 chadwick by fleetwood. 4 bedrooms, 2 baths, 1722 Sq Ft. The mold is in between the walls, in the carpets, ducts, plant soil, were talking everyplace. Then the unspooken amounts it will be to reside and condition the outside of the house.
The findings of mold all have one common trait, orgin of start growth, the kickboards through out the entire home. Well come to learn, this home has only ONE stand of silicon on it. That is the trim on the front of the home. Not all around the home, not the windows, the trim, the vents, nothing. Nothing has ever been sealed on this home. In addition to that, with what I can find on the house, it does not agree with any of the zoned climate it is located. The overhang on my roof does not butt together anywhere! Large gaps, warps along siding, trim. Who ever placed the home didnt even bother putting on the metal track things to seal overhand, and roof!
So as you can see, I have a major issue. I have been told it would be to my best interest to get an Attorney, and take this onto Fleetwood. When you get into the details not given in this letter, I am thinking I might have a fighting chance. I do not know anyone who has gone through this, nor do I know the smart direction to go with this.
Look I have a six year old daughter, a four year old son, a husband that works 125 miles away. I sit alone in this fungus fested pit researching endlessly about simaliar situations. So I must say I have become very educated about mold, the types, the orgins, growth, dormants, spores whatever it might be, I am up to date. I need to find an Attorney that will help me take this on. Any suggestions?
Thank you for your desire to be so involved with this. I was hoping that I could find a person who has been there done this, and can give me some light on whats ahead.
Desperate, unexperenced, and in need of any info
Thank you
T. Hobbs
: I’m trying to put together a listing
: of people who have been taken
: advantage of, who were sold a
: defective home, who had an improper
: set up, or who were unable to get
: warranty support from the
: manufactured housing industry. The
: reason for this is primarily to
: explore the possibilities of
: litigation, and secondarily to
: provide an additional resource for
: manufactured home owners. I know
: that most buyers have been made to
: sign arbitration clauses, but such
: clauses are not always binding,
: depending on your state law and the
: exact wording of your particular
: agreement. The general idea is to
: give people a better idea of others
: who have experienced the same type
: of problem in their geographic
: region and to see what legal
: remedies might be available to them.
: Even if a class action lawsuit would
: not be possible with respondents,
: such sharing of information should
: aid individual lawsuits (for
: instance, allowing different
: plaintiffs to share depositions
: regarding a particular manufacturer
: or problem – which would strengthen
: their cases while decreasing overall
: costs). If this is something you
: would like to explore with me,
: please contact me with some basic
: information: 1. The type problem or
: problems you had. Did it involve
: fraud, a defective home, a defective
: set up, or warranty problems?
: 2. The manufacturer (and specific
: model if possible) of your home and
: the date purchased.
: 3. Your contact information.
: Preferably an e-mail address, a
: phone number if you’re willing to
: share it, and the city and state you
: live in.
:
: I would also like to hear from
: anyone who has experience in
: bringing lawsuits against the
: industry whether successful or
: unsuccessful. Any attorneys with
: proposals or suggestions are
: particularly requested to contact
: me. I would prefer if this
: information (both from a consumer
: end and a legal perspective) is sent
: via the feedback form on this page:
: Your information will not be sold,
: you won’t be put on a mailing list,
: or anything else. (I am deluged with
: spam myself, and wouldn’t wish it on
: anyone.) If I do receive substantial
: feedback, I will e-mail everyone one
: time to share what I’ve learned and
: to share contact information so
: members of the pool can contact
: other consumers with similar
: problems or other customers in their
: area. If it looks like something
: more is possible on a group scale,
: that will be discussed, too. If an
: attorney offers to help, that
: information will be directly shared
: with everyone – and there won’t be
: any kickbacks or stipulations.
: That’s it in a nutshell, so to
: speak. If you know of anyone else
: who might be interested, please let
: them know about this, too. The
: success of this venture depends on
: the number of people who are willing
: to get involved. Thanks in advance
: to anyone who can help!
:
: On a side note, my web site has what
: I feel is a really good list of
: resources for anyone who has a
: manufactured home or who is
: considering one (dozens of links for
: manufactured housing consumers,
: homeowner groups, government
: resources, manufacturer web sites,
: and even a number of books on the
: subject of manufactured housing):
: Please don’t buy one of these homes
: without doing your homework, or the
: chances are good that you will
: regret it. Use the resources that
: are available. If you want a chance
: to win one of ten Amazon.com Lucky
: Breaks shopping sprees being given
: away (each worth $1,000), please go
: to this page as well:
: . The entry form is quick and easy.
: (Warning for the guys: it’s for
: beauty supplies – but your wife or
: girlfriend will love you for it!)
: Contest ends April 30th, so hurry!
