Was this law in place when this happened? Are there not already laws on the books that cover both distracted driving, and vehicular homicide? Do extra fines because of the manor of an accident undo the damage? It's my experience that more laws and fines do little to shape better behavior. I can see reasonable regulations to help stem the problem of texting and driving. For I bought my car 5 years ago, it syncs to my phone via bluetooth. When I'm in my car, my phone does not make any indication that I have received a text. If I get a call it gets routed through the car. It's like that by default. Phone companies could probably find (or be forced into finding) a cleaver way to make it so you can't get or send a text while your driving. It might not even be that hard. THAT would save lives from texting, reduce the chances of an accident caused by the distraction of police activity at the side of the road.
