Get real. Small claims court? The cop could claim it was a piece of evidence. Come on machine. Yes small claims court. Did the officer charge him with anything in which the hat could have been used evidence? If so it should still be in the evidence locker. Bottom line; the cop was way out of line when he took the kids hat. He should be held accountable for that. Even if the kid was being a disrespectful little b###h. I will quote the 4th again, "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." I would seem to me that police are clearly require to get a warrant to seize something or someone. Once again, the police lacking even so much as probable do as they wish. It's is not acceptable to let a police officer over step his bounds. This officer did that when he confiscated that hat. The ticket, the boy may have deserved. To have his rightful, legal property STOLEN by an "officer of law" is absurd. For all we know the officer thought the hat looked cool and wanted it for himself.
