Has anyone ever successfully challenged the non-compete clause that must be signed when a CTDU (Chgo) member retires? My bro-in-law can retire now, however, if he decides to work in any field involving driving, ie. truck, limo, taxi, dock work, etc, etc, he would have to forfeit his pension. He needs to work in order to get health benefits. It seems to me that he could mount a legal challenge on those grounds alone. Any thoughts? Thx. JM
